Terms of Service
aityx, a product of Aletyx, Inc.
Tech preview. Last updated October 7, 2026.
This page describes the terms that govern access to and use of aityx (the “Service”), a decision API and console operated by Aletyx, Inc., a Delaware corporation with a business address at 2500 Regency Parkway, Cary, NC 27518 (“Aletyx,” “we,” or “us”). By creating an account, accepting a tech preview invitation, or using the Service, you (“you” or “Customer”) agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.
1. Definitions
“Console” means the web-based interface at console.aityx.ai.
“API” means the programmatic interface through which the Service is accessed.
“Content” means the States, Questions, and Documents you submit to the Service.
“States” means the facts or data describing a situation that you submit for evaluation.
“Questions” means the specific queries or decisions you ask the Service to resolve against a given State.
“Documents” means source material, such as policies, rule descriptions, or migrated legacy logic, that you upload to inform generation of a Model.
“Model” means the executable decision definition generated by the Service from your Content.
“Decision Definition” means a specific, identified version of a Model, as distinct from the natural-language Question or Document that produced it.
“Validated Inputs” means States that have passed the Service’s schema and format validation prior to evaluation.
“Receipt” means the record the Service returns for a given evaluation, including the result and the supporting evaluation trail.
“Cache” means the Service’s temporary storage of a generated Model for reuse against repeated or similar Questions, as described in Section 5.
“Credits” means the prepaid balance described in Section 8.
“Documentation” means any user guides, API reference material, or similar materials Aletyx publishes for the Service.
“Tech Preview” means the current phase of the Service, as described in Section 2.
2. The Service; Tech Preview Status
aityx is a decision API and console operated by Aletyx. During the Tech Preview, access is granted to approved accounts at Aletyx’s discretion and may be changed, limited, or withdrawn at any time, including with respect to accounts already approved. The Tech Preview is intended for evaluation, integration testing, and low to moderate volume use. It is not intended for production workloads that require contractual availability commitments.
You acknowledge that the Tech Preview is not designed or supported for use in making or supporting a final decision regarding an individual’s credit, employment, insurance, healthcare, housing, or other legally significant eligibility determination without independent human review, and that Aletyx assumes no responsibility for a Decision Definition deployed in that manner during the Tech Preview.
Aletyx may modify, add, or remove features of the Service, including the generation and execution behavior described in Sections 4 and 5, at any time and without advance notice, consistent with the Tech Preview nature of the Service.
3. Accounts and Access
You are responsible for all activity under your account and API credentials. Credentials must be kept confidential and must not be embedded in client side code or any location accessible to unauthorized parties. If you believe a credential has been compromised, you must notify Aletyx and may remain responsible for activity occurring before you do so.
You must provide accurate account information and be legally able to enter into these Terms. You must be at least 18 years old to use the Service. The Service is not directed to children, and Aletyx does not knowingly permit use by anyone under 18.
4. Your Content
States, Questions, Documents, Models, and Receipts you submit or generate through the Service remain yours. We process your Content to provide the Service, including to generate and execute Models and to return Receipts. We do not use your Content to train models for other customers.
We may process de-identified, aggregated information derived from Content, such as volume, latency, and error-rate statistics, to operate, secure, and improve the Service. This does not include the substance of your States, Questions, Documents, or Receipts in a form that identifies you or allows reconstruction of your Content.
5. Generated Models, Decision Definitions, and the Cache
When you submit a Question against a State, or a Document intended to inform a Model, the Service may generate a Model to evaluate it. A generated Model may be reused through the Cache for repeated or similar Questions. The Cache is temporary. If the Cache no longer holds the Model associated with a prior Question, a repeated submission of that Question may produce a new, separately generated Decision Definition rather than re-execute the earlier one.
You are responsible for retaining the Models and Receipts you need. The Service does not guarantee indefinite storage of generated Models, Decision Definitions, or Receipts beyond the Cache window described above. If you require long-term reproducibility of a specific decision, you should export and retain the Decision Definition and the associated Receipt rather than rely on resubmitting the original Question.
6. Receipts
A Receipt is a record of a single evaluation, including the result and the supporting evaluation trail for that Decision Definition. A Receipt reflects how the Service evaluated the Validated Inputs against a specific Decision Definition at the time of evaluation. A Receipt is not, by itself, a representation that the underlying Decision Definition correctly implements any law, regulation, policy, or business requirement.
7. Acceptable Use
You will not use the Service to:
(a) submit Content you do not have the right to share, including Documents containing another party’s confidential or proprietary logic without authorization;
(b) submit personal data beyond what a given decision requires, or that you are not authorized to process;
(c) submit content intended to attack the Service, probe its infrastructure, or interfere with other users’ access;
(d) systematically query the Service with the purpose of reconstructing, extracting, or deriving the underlying logic of a Model or Decision Definition you do not own, whether through boundary-value probing, automated enumeration, or similar means;
(e) resell or sublicense raw API or Console access to a third party without Aletyx’s prior written consent;
(f) use a Decision Definition to make or support a decision that unlawfully discriminates against an individual on the basis of a legally protected characteristic;
(g) submit Content or construct a Question, State, or Document that depicts, describes, or determines the permissibility, eligibility, or classification of child sexual abuse material or any sexual content involving a minor, or that otherwise facilitates the exploitation of a minor;
(h) submit Content for any other illegal purpose, including content that facilitates violence, terrorism, or the unlawful manufacture or acquisition of weapons; or
(i) use the Service, its Output, or any Decision Definition or Receipt to develop, train, or improve a product or service that competes with the Service.
A request framed as a decision, eligibility, classification, or permissibility question is evaluated under this Section the same as a direct request for the underlying content or conduct. Framing does not change the analysis.
Aletyx may suspend or terminate access immediately and without prior notice for a violation of subsection (g), and may suspend or terminate access for violation of any other part of this Section without refund of Credits already consumed. Where practicable, Aletyx will provide notice before or promptly after a suspension or termination under this Section, except where notice would be inappropriate given the nature of the violation.
8. Fees and Credits
Approved accounts receive a Credit balance. Billable Console and API calls deduct from that balance at the rates published at Pricing. A call cannot proceed without a sufficient available balance.
Cached Questions-based calls are billed at the same System Two rate as other Questions-based calls. Rates for Model generation, execution against a Cached Decision Definition, and other call types are as published on the pricing page and may differ.
Credits have no cash value except as described in Aletyx’s Refund Policy, if any, do not accrue interest, and may expire after a period of account inactivity or upon account closure. Credits are not transferable and do not constitute a property interest.
You are responsible for any sales, use, value-added, or similar taxes associated with your purchase of Credits, other than taxes based on Aletyx’s net income.
9. Data Security
Aletyx maintains administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of Content. Aletyx maintains a SOC 2 compliance program at the organizational level and will make a summary of its current security posture available on request. Aletyx will notify you without undue delay upon confirming unauthorized access to or disclosure of your Content that compromises its confidentiality or integrity.
10. Data Processing Addendum
If applicable law requires a data processing agreement governing Aletyx’s processing of personal data within your Content, or if you request one in writing, the parties will enter into Aletyx’s then-current Data Processing Addendum, which will be incorporated into these Terms by reference upon execution. Until a Data Processing Addendum is executed, Aletyx processes personal data within your Content solely as necessary to provide the Service, consistent with Section 4.
Aletyx may engage subcontractors and service providers, including cloud infrastructure providers, to process Content on Aletyx’s behalf, and remains responsible for their compliance with these Terms.
11. Intellectual Property
11.1 Your Content
As between the parties, you own your Content and the Decision Definitions and Receipts generated from it, subject to Aletyx’s processing rights in Section 4.
11.2 The Service
Aletyx retains all right, title, and interest in the Service, including its software, infrastructure, the generation and execution engine, and any Aletyx-developed methodology, independent of any specific Model generated for you. Aletyx’s retained rights include any pre-existing templates, pattern libraries, or generalized decisioning methodology incorporated into a generated Model. Your ownership under Section 11.1 extends to the Decision Definition as applied to your specific Content, and not to Aletyx’s underlying templates or methodology.
11.3 Feedback
If you provide feedback or suggestions regarding the Service, you grant Aletyx a perpetual, irrevocable, royalty free license to use that feedback without restriction or obligation to you.
12. Confidentiality
Each party will protect the other’s non public business and technical information disclosed in connection with the Service using at least the same degree of care it uses for its own confidential information, and will not disclose it except to employees, contractors, and advisors with a need to know and an obligation of confidentiality at least as protective as this Section. This does not apply to information that is or becomes public without breach of this Section, was already known without a confidentiality obligation, is independently developed, or must be disclosed under legal compulsion, with notice to the other party where legally permitted.
13. Disclaimer of Warranties
13.1 Reproducibility
For a specific, retained Decision Definition and a given set of Validated Inputs, the Service will produce the same Receipt. This commitment runs to the identified Decision Definition, not to the original Question or Document. As described in Section 5, if the Cache no longer holds the Model associated with a prior Question, resubmitting that Question may generate a new Decision Definition that differs from the earlier one. Aletyx does not warrant that a resubmitted Question will produce the same Model or Receipt as a prior submission once the Cache window has passed.
13.2 No warranty of business logic correctness
Aletyx does not warrant that a Model or Decision Definition, whether generated by the Service or supplied by you, correctly implements any particular law, regulation, policy, or business requirement, including logic migrated or derived from a legacy system. You are responsible for reviewing and validating a Decision Definition before relying on its Receipts, particularly in regulated or customer facing workflows.
13.3 No regulatory notice
A Receipt is not legal, regulatory, or compliance advice and does not satisfy any legally required notice to an individual, including adverse action or fair lending notice requirements. You are solely responsible for providing any legally required notice or explanation arising from use of a Receipt.
13.4 General disclaimer
Except as expressly stated in Section 13.1, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Aletyx does not warrant that the Service will be uninterrupted, error free, or continuously available during the Tech Preview. Nothing in this Section limits any right that cannot be waived or limited as a matter of applicable law.
14. Indemnification
14.1 By Customer
You will defend, indemnify, and hold harmless Aletyx and its officers, employees, and agents from third party claims arising out of (a) your Content, including Documents you were not authorized to submit, (b) your breach of Section 7, or (c) your use of a Receipt or Decision Definition in violation of applicable law.
14.2 By Aletyx
Aletyx will defend you against a third party claim alleging that the Service itself, excluding your Content, any Decision Definition generated from Documents you supplied, and any combination of the Service with items not provided by Aletyx, infringes that party’s United States patent, copyright, or trademark, and will indemnify you against damages finally awarded, provided you promptly notify Aletyx, give Aletyx sole control of the defense and settlement, and provide reasonable cooperation.
14.3 Procedure
The indemnifying party’s obligations are conditioned on prompt written notice, sole control of defense, and reasonable cooperation from the indemnified party.
15. Limitation of Liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to these Terms or the Service. Each party’s total aggregate liability will not exceed the greater of (a) the amounts you paid to Aletyx in the twelve months preceding the event giving rise to the claim, or (b) $50 USD. This cap does not apply to either party’s indemnification obligations under Section 14 or to a breach of confidentiality under Section 12.
16. Term; Suspension; Termination
You may stop using the Service at any time. Aletyx may suspend or withdraw Tech Preview access, in whole or in part, at any time, consistent with Section 2, including for a violation of Section 7. Aletyx may update these Terms at any time; material changes will be reflected in the “Last updated” date above, and continued use after that date constitutes acceptance.
Upon termination, Aletyx has no obligation to retain your Content, Models, Decision Definitions, or Receipts, and may delete them at its discretion, except as required by Section 10 (Data Processing Addendum) or applicable law. You are responsible for exporting anything you wish to retain before termination takes effect.
Sections 4, 6, 9, 10, 11, 12, 13, 14, 15, 17, 19, and 20 survive termination.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service will be resolved in the state or federal courts located in Wake County, North Carolina, and each party submits to the jurisdiction of those courts.
18. Export Control
You represent that you are not located in, and will not use the Service from, a country or region subject to comprehensive United States sanctions, and that you are not on any United States government restricted party list.
19. Trademarks; Third-Party Marks
aityx is operated by Aletyx and is not affiliated with, endorsed by, or sponsored by TypeSafe AI, Inc. Jev, System One, and TypeSafe are trademarks of their respective owners. References to Jev on this site, including comparative or migration-oriented content, are for identification and comparison purposes only and do not imply any affiliation, sponsorship, or endorsement.
20. General Provisions
20.1 Assignment
You may not assign these Terms without Aletyx’s prior written consent, except to a successor in a merger, acquisition, or sale of substantially all assets. Aletyx may assign these Terms freely in connection with a similar transaction.
20.2 Entire Agreement
These Terms, together with the Privacy Policy at aletyx.ai/legal/privacy/ and any Documentation referenced here, are the entire agreement between you and Aletyx regarding the Service, except that a signed order form between you and Aletyx will govern to the extent it conflicts with these Terms.
20.3 Severability; Waiver
If a provision is held unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver of the right to enforce it later.
20.4 Notices
Notices to Aletyx should be sent to [email protected] or 2500 Regency Parkway, Cary, NC 27518. Notices to you will be sent to the email address associated with your account.
20.5 Force Majeure
Neither party is liable for delay or failure to perform an obligation under these Terms, other than a payment obligation, due to causes beyond its reasonable control, including acts of government, natural disaster, war, terrorism, labor disputes, or internet or utility failures.
20.6 Independent Contractors
The parties are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship.
20.7 Government End Users
If you are an agency, department, or other entity of the United States federal, state, or local government, your use, duplication, or disclosure of the Service and any related documentation is restricted in accordance with the applicable Federal Acquisition Regulation and its supplements, or corresponding state or local procurement terms, and is subject to Aletyx’s standard commercial terms to the maximum extent permitted by applicable law.
20.8 Publicity
You grant Aletyx the right to use your name, logo, and trademarks to identify you as a user of the Service in Aletyx’s marketing materials, website, customer lists, case studies, and press releases. Aletyx will cease this use within a reasonable time after receiving your written request to stop. Nothing in this Section grants you any right to use Aletyx’s name, logo, or trademarks, except as separately agreed in writing.
